Terms & Conditions

These Terms & Conditions apply to all services provided by King CMC through kingcmc.ie, including construction, renovations, property maintenance, property cleaning, interior and exterior works, and residential and commercial projects. They set out how we quote, deliver, invoice and stand behind our work.

The agreement between us is governed by Irish law. Nothing in this document limits or removes your statutory rights as a consumer.

  1. Definitions

    In these Terms & Conditions the following words have the meanings set out below:

    • "King CMC", "we", "us" or "our" means King CMC, a construction, maintenance and cleaning services business operating in Ireland through the website kingcmc.ie.
    • "Client", "you" or "your" means the person, firm, company or other body that engages King CMC to carry out the Works.
    • "Works" means the construction, renovation, maintenance, cleaning, interior or exterior services described in the Quotation and any agreed Variations.
    • "Quotation" means the written estimate or fixed price document issued by King CMC describing the Works and the Price.
    • "Contract" means the agreement between King CMC and the Client formed in accordance with the Basis of Contract section below.
    • "Site" means the property or location at which the Works are to be carried out.
    • "Variation" means any addition, omission or change to the Works agreed after the Contract is formed.
    • "Practical Completion" means the point at which the Works are complete and usable for their intended purpose, save for minor snagging items.
  2. Basis of Contract

    These Terms & Conditions apply to all services provided by King CMC, whether enquired about through kingcmc.ie, by telephone, WhatsApp, email or in person, and they form the entire agreement between us unless we agree otherwise in writing.

    A Contract comes into existence when you accept our Quotation in writing (including by email or messaging app), pay a deposit, or instruct us to begin the Works — whichever happens first. Any terms you put forward that conflict with these Terms have no effect unless a director of King CMC accepts them in writing.

    Nothing in these Terms limits or excludes your statutory rights as a consumer under Irish or European Union consumer protection law.

  3. Scope of Works

    The Works are limited to what is expressly described in the Quotation. Anything not listed — including works implied by drawings, third-party specifications or verbal discussion — is excluded unless confirmed in writing.

    King CMC provides the following categories of service:

    • Construction and new build works
    • Renovations, refurbishment and extensions
    • Property maintenance and reactive repairs
    • Property and commercial cleaning
    • Interior and exterior works
    • Residential and commercial projects
  4. Estimates & Quotations

    Quotations are valid for 30 days from the date of issue unless stated otherwise, and are based on the information, access and site conditions known to us at the time of pricing.

    Where a document is described as an estimate rather than a fixed price, it is an informed projection of likely cost and the final amount may differ once the full extent of the Works is established. We will advise you as soon as we become aware of any material difference.

  5. Design & Client Responsibilities

    Unless we have been separately engaged to provide design services, King CMC builds to the designs, drawings, specifications and measurements supplied by you or your appointed professionals, and we are not responsible for defects arising from them.

    You are responsible for:

    • Obtaining planning permission, fire safety certificates, disability access certificates and any other statutory consents required for the Works.
    • Ensuring you have the legal right to instruct works at the Site, including any landlord, management company or party wall consents.
    • Providing accurate information about the property, including the location of services, drains and cabling where known.
    • Making timely decisions on selections, finishes and specifications so that the programme is not delayed.
  6. Project Management

    King CMC will manage the day-to-day running of the Works, including sequencing, labour, our own subcontractors and deliveries. We will nominate a point of contact for the project and ask that you nominate a single decision-maker for instructions on your side.

    Instructions that materially affect cost, programme or specification must be given to our nominated contact in writing. Instructions given directly to operatives on site are not binding.

  7. Pricing

    Prices are quoted in euro. VAT is charged at the rate applicable on the date of invoice and is shown separately. Where the Works qualify for reverse-charge VAT under Irish Revenue rules for principal contractors, this will be stated on the invoice.

    Prices assume normal working hours, reasonable access and continuous working. Out-of-hours working, restricted access, or works suspended and remobilised at your request may attract additional cost, notified to you in advance.

  8. Deposits

    A deposit may be required before the Works commence in order to secure your place in our programme and to fund the procurement of materials. The deposit amount will be stated in the Quotation.

    Deposits are applied against the final account. Where you cancel after we have ordered materials or committed labour, we may retain so much of the deposit as covers our reasonable costs actually incurred, and we will refund the balance promptly.

  9. Payment Terms

    Unless the Quotation says otherwise, payments are due in stages linked to progress on site, with the final balance due on Practical Completion. Invoices are payable within 7 days of issue.

    Late payment may attract interest and reasonable recovery costs in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations, which apply to business clients only. We may suspend the Works where an undisputed invoice remains unpaid after written notice.

    Snagging items do not entitle you to withhold the full final payment; only a reasonable sum proportionate to the value of the outstanding items may be retained.

  10. Variations

    Any change to the Works is a Variation. We will confirm the cost and any programme impact of a Variation in writing before proceeding wherever practicable.

    Where urgent works are required to keep the project safe or watertight and it is not practicable to obtain prior written agreement, we may proceed and charge on a reasonable time-and-materials basis, notifying you as soon as possible.

  11. Hidden & Unforeseen Site Conditions

    Quotations are based on visible conditions at the time of survey. Conditions that could not reasonably have been identified without opening up the structure — including rot, damp, asbestos, structural defects, non-compliant prior works, contaminated ground, or unmarked services — are excluded.

    Where such conditions are discovered we will stop the affected part of the Works, inform you, and provide a price for the additional works. Any resulting cost or delay is treated as a Variation.

  12. Delays

    Programme dates are estimates given in good faith and are not of the essence unless expressly agreed in writing.

    We are not liable for delay caused by matters outside our reasonable control, including late client decisions, late statutory consents, supplier shortages, adverse weather, or the performance of contractors not appointed by us. Where such delay occurs, the programme is extended by a reasonable period.

  13. Site Access

    You must provide safe, clear and uninterrupted access to the Site during agreed working hours, along with reasonable access to electricity, water and welfare facilities where available.

    Please clear the working areas of furniture, personal belongings, vehicles and valuables before we begin. Where we are unable to work because access is not available, standing time may be charged.

  14. Materials

    All materials supplied by King CMC remain our property until paid for in full. Risk in the materials passes to you on delivery to the Site.

    Natural materials such as timber, stone and tiles vary in colour, grain and texture, and minor variation from samples is not a defect. Where you supply materials yourself, we accept no responsibility for their quality, suitability, shortfall or lead time, and any resulting delay or rework is chargeable.

  15. Waste Removal

    Waste generated by the Works will be removed and disposed of through authorised waste collectors in accordance with Irish waste management legislation, unless the Quotation states that disposal is excluded.

    Removal of pre-existing waste, hazardous material or items unrelated to the Works is not included and will be priced separately.

  16. Third-Party Contractors

    Where you engage contractors, suppliers or professionals directly, they remain your responsibility. We will co-operate reasonably with them but accept no liability for their work, delays, health and safety conduct, or damage they cause.

    Our warranty does not extend to any part of the Works altered, completed or interfered with by a third party.

  17. Completion & Snagging

    On Practical Completion we will invite you to inspect the Works and to provide a single consolidated written snagging list within 7 days.

    We will attend to legitimate snagging items within a reasonable period. Items reported after that window are dealt with under the workmanship warranty below rather than as snagging.

  18. 12-Month Workmanship Warranty

    King CMC warrants its workmanship for 12 months from the date of Practical Completion. If a defect in our workmanship appears within that period, notify us in writing and we will repair it at no charge.

    The warranty does not cover:

    • Fair wear and tear, shrinkage, settlement cracking and normal drying-out movement.
    • Damage caused by misuse, neglect, lack of maintenance, accident or extreme weather.
    • Works altered, repaired or extended by anyone other than King CMC.
    • Materials or items supplied by the Client or by a third party.
    • Any part of the Works for which payment remains outstanding.

    This warranty is in addition to, and does not affect, your statutory rights.

  19. Manufacturer Warranties

    Products such as boilers, windows, doors, roofing systems, appliances and coatings carry the warranty of their manufacturer. We will pass the benefit of those warranties to you where we are able to do so.

    Manufacturer warranties are subject to the manufacturer's own terms, including any registration and servicing requirements, which are your responsibility to maintain.

  20. Liability

    King CMC maintains public liability insurance appropriate to the Works we carry out. Evidence of cover is available on request.

    We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under Irish law. Subject to that, our total liability arising out of the Contract is limited to the Price paid for the Works, and we are not liable for indirect or consequential loss, loss of profit, loss of rent or loss of business.

  21. Complaints & Dispute Resolution

    If something is not right, contact us first at kingcmcireland@gmail.com or on +353 (83) 098 1489. We aim to acknowledge every complaint within 5 working days and to resolve it as quickly as possible.

    If a dispute cannot be resolved directly, both parties agree to attempt mediation or conciliation in Ireland in good faith before commencing legal proceedings. This does not prevent either party from seeking urgent relief from the courts.

  22. GDPR & Privacy

    King CMC is the data controller for personal data collected through kingcmc.ie and in the course of providing the Works. We process your name, contact details, property address and project information for the purposes of quoting, delivering and invoicing the Works, and for keeping records required by law.

    We do not sell your data. We retain it only for as long as necessary for the purposes above and for applicable statutory retention periods. You have the right to access, correct, erase, restrict or port your data, and to object to processing — contact us at kingcmcireland@gmail.com. You may also lodge a complaint with the Irish Data Protection Commission.

  23. Photography of Completed Works

    We may photograph completed Works for our portfolio, website and social media. Images will not identify your full address or show personal belongings, occupants or security arrangements.

    You may ask us not to photograph your project, or ask us to remove published images, at any time by writing to us.

  24. Force Majeure

    Neither party is liable for failure or delay in performing its obligations where caused by events beyond its reasonable control, including severe weather, flood, fire, epidemic or pandemic, war, civil unrest, industrial action, failure of utilities, government restriction or supply-chain failure. Obligations are suspended for the duration of the event, and where it continues for more than 60 days either party may terminate the Contract, with payment due for Works properly carried out to that date.

  25. Governing Law

    These Terms & Conditions and the Contract are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute arising from them.

    Nothing in these Terms affects or limits your statutory rights as a consumer under Irish law.
